Surrogacy in India

In 2002 Indian women got the right from the government of India to make money by renting their organisms for bearing children. From that time this business has become a whole branch, moreover very profitable. Annual amount of the surrogate motherhood services market is estimated in 2, 3 billion dollars and is growing rapidly. It is explained by two reasons. Firstly, it is possible to buy surrogate mother’s services without bureaucratic procrastinations at the black market. Secondly, it is simply cheap. Indian government plans to start controlling the surrogate motherhood market more severely in two directions. From the one side, it will apply control to the numerous clinics engaged in extra corporal fertilization (IVF), pregnancy care and further giving birth. From the other- it will increase social security of Indian women, who earn their living by such means. According to the new bill, surrogate mothers will have more increased social security; it will be allowed to implant maximum three embryos (earlier it was five) and will be limited by the time frames: it can be possible to bear children for other couples only till the age of 35 as it is in Russia.

If the bill is adopted, Indian government, known for its excessive bureaucracy, will keep a more close watch on surrogate mothers, clinics and also the clients. For the latter (as a rule, these happen to be couples from the countries where surrogate motherhood is prohibited, and also homosexual couples from successful countries) the price of the matter will most likely increase.

Although with all its affordability Indian surrogate motherhood has another side - the majority of the potential surrogate mothers belongs to the poor layers of population, that doesn’t exclude the presence of illnesses and hidden health problems and requires the necessity of the serious medical examination of these women. In any case, medical tourism gives new possibilities in the field of surrogate motherhood.

Another pole of reproductive tourism is India. Here the most complicated programs, including surrogate motherhood, will cost only 15 thousand Euros. Though, in addition to the child, it is possible to obtain a whole set of problems: from insanitary conditions to legislative mistakes – there is a known case when a couple from Bavaria was winninging for several years the right to enter FRG with the twins born for them by an Indian woman. The level of corruption is very high in India, there is no corresponding legislation for processing papers for taking out the children.
