Surrogacy in Ukraine
What goes for the IVF and Surrogate motherhood in Ukraine, there is a wide range of judicial issues by which Ukrainian legislative system differs from the majority of other western countries. Ukraine is one of a few countries in Europe welcoming surrogate motherhood. It doesn’t limit surrogate motherhood by the corresponding impositions and doesn’t require the court’s resolution. Child’s adoption isn’t necessary. A family - recipient supplies an embryo created either by themselves or transferred to the surrogate mother by means of the IVF. Ukrainian legislation allows receiving a birth certificate with the name of the intended parents, regardless of their genetic connection with the child.
The Instruction about the procedure of implementing new reproductive technologies, approved by the Order of the Ministry of health care of Ukraine “About the approval of the Instruction concerning the procedure of assisted reproductive technologies implementation“ # 771 from December 23rd 2008 states that:
Assisted reproductive technologies (ART) are carried out exclusively at the officially designated health care establishments:
Patients can freely choose a health care establishment to carry out ART;
ART procedures are carried out by specialists possessing all the required professional skills;
A full – aged woman or a man has the right according to the medical indications for carrying out with relation to them ART treatment programs following the article 281 of the Civil Code of Ukraine;
Medical help with accordance to ART methods is rendered in conditions of confidentiality following the article 40 of The Legislation Basics of Ukraine concerning health care;
Besides strictly legislative aspects of surrogate motherhood, acknowledgement and registration of paternity there are many civil - legislative issues arising between a couple and a surrogate mother. These relations are regulated by contracts.
Thus, taking into consideration the norms of the acting legislation of Ukraine, the entire process of surrogate motherhood is considered to be legitimate.
